This Generative Creative Lab Non-Commercial License (the “License”) governs your access to and use, modification, and distribution of the software project known as Generative Creative Lab (as defined below). By downloading, accessing, installing, using, modifying, or distributing any part of Generative Creative Lab, you agree to be bound by this License. If you do not agree to this License, you must not use Generative Creative Lab.

1. Definitions

For purposes of this License:

  1. “Generative Creative Lab” means the modular framework and associated software components made available by the project owner under this License, including but not limited to:

    • Django applications, Celery tasks, orchestration logic, configuration and management scripts.

    • Pipelines and modules for multi-model diffusion image generation, dynamic model composition, prompt enhancement, and other generative AI workflows.

    • Any included documentation, configuration files, or example assets distributed with the project repository.

  2. “Derivative” means any work, software, or other material that is based on, incorporates, builds upon, or is otherwise derived from Generative Creative Lab or any portion of it, including modifications, adaptations, plugins, integrations, or combinations with other software that are distributed as a unified whole.

  3. “Distribution” / “Distribute” means providing or making available any copy of Generative Creative Lab or a Derivative, in whole or in part, to any third party by any means, including without limitation via source code hosting platforms (such as GitHub), package repositories, container registries, or pre-built binaries.

  4. “Non-Commercial Purposes” means:

    • Personal study, experimentation, or hobby projects not carried out for or on behalf of a for-profit entity and not generating revenue.

    • Academic or scientific research and related publications, provided such use is not directly tied to a commercial product or service.

    • Internal testing, evaluation, or research and development by any entity in a non-production environment, where Generative Creative Lab and any Derivatives are not used to provide functionality to paying customers or other external end users.

    • Use by charitable or non-profit organizations for their charitable, educational, or research purposes, where such use does not involve selling access to Generative Creative Lab, a Derivative, or any hosted service built on it.

    For clarity, use is not a Non-Commercial Purpose if it:

    • Generates or is intended to generate revenue, fees, or other commercial advantage (including through subscriptions, usage-based billing, consulting fees tied to the deployed system, or paywalled access).

    • Is provided in or underpins a production service, tool, or platform made available to external end users (paid or free) as part of a business.

    • Is used to develop or operate a commercial product, including but not limited to creative tools, SaaS offerings, or APIs, whether or not Generative Creative Lab is visible to end users. []

  5. “You” / “Your” means the individual or legal entity exercising rights under this License.

2. License Grant

Subject to Your compliance with this License:

  1. Grant. The project owner grants You a non-exclusive, worldwide, non-transferable, non-sublicensable, revocable, royalty-free, limited license to:

    • access and use Generative Creative Lab,

    • modify Generative Creative Lab and create Derivatives,

    • and Distribute Generative Creative Lab and Derivatives, in all cases solely for Your Non-Commercial Purposes.

  2. No Assignment or Sublicense. This License is personal to You. You may not assign, transfer, or sublicense this License or any rights under it without prior written permission from the project owner; any attempted assignment or sublicense is void and automatically terminates this License.

  3. Scope. All restrictions in this License that apply to Generative Creative Lab also apply to any Derivatives You create or that are created on Your behalf.

3. Non-Commercial Use Only

You may only access, use, modify, Distribute, or create Derivatives of Generative Creative Lab for Non-Commercial Purposes. If You wish to use Generative Creative Lab or any Derivative for any purpose that falls outside Non-Commercial Purposes (including, without limitation, use in a commercial product, production service, or revenue-generating activity), You must obtain a separate written commercial license from the project owner, which may be granted or withheld at the project owner’s sole discretion and may require payment of fees, royalties, or other consideration.

4. Distribution Requirements

Subject to this License, You may Distribute copies of Generative Creative Lab and/or any Derivatives, provided that:

  1. License Inclusion. You include a complete, unmodified copy of this License with any Distribution of Generative Creative Lab or a Derivative, and clearly indicate that the use of Generative Creative Lab and such Derivative is governed by this License.

  2. Attribution Notice. You prominently display the following notice in documentation, a NOTICE file, or similar location distributed with Generative Creative Lab or any Derivative (the “Attribution Notice”):

    This project uses or is based on Generative Creative Lab, a modular framework for creative development and experimentation with generative AI.
    Generative Creative Lab is licensed for Non-Commercial Purposes only under the Generative Creative Lab Non-Commercial License.

  3. Source Code Availability. If You Distribute a Derivative in executable or compiled form, You must also make the corresponding source code of that Derivative reasonably available under this same License.

  4. No Misrepresentation. You must not suggest or imply that the project owner endorses You, Your Derivative, or Your use of Generative Creative Lab, unless expressly agreed in writing.

5. Restrictions

You will not, and will not permit or assist any third party to:

  1. Use, modify, copy, reproduce, create Derivatives of, or Distribute Generative Creative Lab or any Derivative:

    • for any commercial or production purpose, or

    • in connection with any service or product offered to third parties for a fee or other commercial advantage;

  2. Offer Generative Creative Lab or any Derivative as part of a hosted service, API, or platform that is used by or accessible to external end users in the course of for-profit activities, including but not limited to:

    • a commercial image generation or creative tooling service,

    • a multi-tenant SaaS platform,

    • or any service where access to Generative Creative Lab-powered functionality is sold, licensed, or bundled into a paid offering;

  3. Remove, obscure, or alter any copyright notices, license notices, or Attribution Notices included with Generative Creative Lab;

  4. Use Generative Creative Lab or any Derivative in violation of applicable law or regulation, including but not limited to:

    • laws relating to privacy, data protection, or intellectual property;

    • or any law or regulation governing the use of AI systems;

  5. Use Generative Creative Lab or any Derivative to knowingly facilitate:

    • unlawful, fraudulent, or deceptive activities,

    • harassment or abuse of individuals or groups,

    • or the creation or dissemination of content that is illegal in the jurisdiction where You operate.

6. Intellectual Property

  1. Ownership. Except for the rights expressly granted to You in this License, the project owner and its contributors retain all right, title, and interest (including all intellectual property rights) in and to Generative Creative Lab.

  2. Your Contributions. If You contribute code, documentation, or other materials to Generative Creative Lab (for example, through pull requests to the project’s GitHub repository), those contributions may be accepted and redistributed as part of Generative Creative Lab under this License or another open-source or proprietary license chosen by the project owner, subject to any separate contributor license agreement that may apply.

  3. Third-Party Components. Generative Creative Lab may rely on or interoperate with third-party software (including AI models such as FLUX.1 [dev]) that are licensed under separate terms. You are solely responsible for understanding and complying with any third-party licenses, including any non-commercial or commercial restrictions applicable to those components.

7. Outputs and Model Usage

  1. Outputs. Generative Creative Lab is designed as a creative laboratory for experimentation with generative models and workflows. You are responsible for ensuring that any outputs generated using Generative Creative Lab (including images, metadata, and logs) are used in a manner consistent with this License and any third-party model licenses You rely on.

  2. Model Licenses. If You integrate external models (including but not limited to FLUX.1 [dev], Stable Diffusion variants, or other diffusion models) into Generative Creative Lab, Your access to and use of those models is governed by their respective licenses, which may include additional non-commercial, attribution, or content-filtering obligations. Your compliance with this License does not relieve You of any obligations under such third-party licenses.

  3. Commercial Use of Outputs. To the extent permitted by the licenses of any underlying models and datasets, You may be able to use outputs generated by those models for commercial purposes; however, any such commercial use must not require or involve using Generative Creative Lab or a Derivative in a manner that violates the Non-Commercial restrictions in this License. In other words, commercial exploitation of outputs cannot depend on providing Generative Creative Lab itself (or a Derivative of it) as a commercial product or service.

8. Term and Termination

  1. Term. This License is effective upon Your first access to, download of, or use of Generative Creative Lab and continues until terminated as described in this section.

  2. Automatic Termination. This License automatically terminates if You breach any of its terms or conditions, including any Non-Commercial restrictions or Distribution requirements.

  3. Effect of Termination. Upon termination:

    • Your rights under this License immediately cease.

    • You must stop using Generative Creative Lab and any Derivatives and destroy any copies in Your possession or control, except as required to comply with legal or regulatory obligations.

  4. Survival. Sections that by their nature should survive termination (including Restrictions, Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.

9. Disclaimers

GENERATIVE CREATIVE LAB IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE PROJECT OWNER AND CONTRIBUTORS DO NOT WARRANT THAT GENERATIVE CREATIVE LAB WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULTS.

You are solely responsible for:

  • evaluating the suitability of Generative Creative Lab for Your use case,

  • implementing appropriate safeguards, testing, and validation procedures,

  • and ensuring that Your use of Generative Creative Lab and any Derivatives complies with applicable law and third-party license terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE PROJECT OWNER OR ANY CONTRIBUTOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS LICENSE OR YOUR USE OF GENERATIVE CREATIVE LAB OR ANY DERIVATIVE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE AGGREGATE LIABILITY OF THE PROJECT OWNER AND ALL CONTRIBUTORS FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THIS LICENSE OR THE USE OF GENERATIVE CREATIVE LAB WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).

11. Governing Law and Venue

This License will be governed by and construed in accordance with the laws of the jurisdiction specified in the project repository or documentation (or, if none is specified, the jurisdiction where the project owner resides), without regard to conflict-of-law principles. Any dispute arising under or relating to this License shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.

12. Changes to This License

The project owner may update or modify this License from time to time. Any updated version will be posted in the project repository. Your continued use of Generative Creative Lab after the effective date of the updated License will constitute Your acceptance of the updated terms.
